After the appeal to return to the Supreme Court of Montenegro, the extradition of Kuo
After another successful appeal from Do Kwon's legal team, the Supreme Court of Montenegro will decide whether to extradite the Terraform Labs co-founder to the US or South Korea.
According to a May 24 report from Montenegrin news outlet Vijesti, the country's appeals court accepted an argument from Quan's lawyers and returned the extradition request to the higher court for “reconsideration and decision.” The appeal is the latest legal tactic Kwon's team has used to delay his extradition to the US or South Korea, where he could face criminal charges.
“If the person requested to be extradited gives consent to extradition, a short procedure must be followed and the court will decide on extradition,” the Montenegrin Court of Appeal said in its decision.
“The trial court was obligated to rehear the defendant, confirming that the extraditee was aware of the consequences of his consent and that the consent could not be revoked.”
Montenegrin authorities arrested Kuo in March 2023 after allegedly using forged travel documents to leave the country. He was sentenced to four months in prison, then released after the courts considered competing extradition requests from the US and South Korea.

In April, a US court found Terraform Labs and Quon liable for fraud as part of a civil case filed by the Securities and Exchange Commission. The judge is scheduled to hear the two sides' settlement at a hearing on May 29.
With Montenegro's courts embroiled in an extradition dispute, it is unclear whether he will be able to defend himself in person in the United States or his native South Korea. If extradited to South Korea, Kwon will face charges of fraud and violating the Capital Markets Act.
